Eight States Sue to Block Release of Plans for 3D-Printed Firearms

Eight States Sue to Block Release of Plans for 3D-Printed Firearms

Despite those victories, the federal government announced a settlement with the firearms groups this month, allowing the 3D gun manuals to be distributed online.

The company said in court that they began distributing gun files early and that 1,000 people had downloaded 3-D plans for AR-15s since Friday.

Guttenberg and others worry the lax access to guns is a public-safety issue and would mitigate current regulations, providing criminals and terrorists with "guns that can't be flagged by metal detectors, don't have serial numbers to trace and don't require the usual background checks".

The complaint is not yet available to the public but Ferguson's office says the Second Amendment Foundation and Defense Distributed will be named in the lawsuit as "necessary parties".

Washington state Attorney General Bob Ferguson speaking at the 2017 GeekWire Summit. A few of the states have already taken more immediate action to block Defense Distributed from disseminating the digital firearm blueprints.

"There is no indication in the settlement agreement or elsewhere that any analysis, study or determination was made by the government defendants in consultation with other agencies", says the release from the Attorney General's Office. "Defense Distributed was promising to distribute guns in Pennsylvania in reckless disregard of the state laws that apply to gun sales and purchases in our Commonwealth. The company also agreed to not upload any new gun files to its sites - another important development". "Attorney General Shapiro and I will fight to protect Pennsylvania families and children". They argue that the USA government failed to get approval for the settlement from the Defense Department or Congress, and thus broke a federal rule. The federal government had prevailed at every step in the court process, according to PBS, until they suddenly agreed to settle Wilson's lawsuit out of court, allowing him to distribute the plans and even giving him $40,000 in legal fees. "They fund its direct, material expansion", according to the lawsuit. "We have the right to share it. Pennsylvania has no right to come in and tell us what we can and can't share on the internet".

The settlement followed a long legal battle between self-described anarchist Cody Wilson, 30, Defense Distributor's founder, and the department.

In New Jersey, officials also had sought to block downloading of the plans for that state's residents by means of a cease-and-desist letter.

The suit asks for a temporary restraining order nationwide that would cover both the federal government lifting export controls and Defense Distributed from posting the downloads.
